(the “Owner”), you agree to be bound by these Terms of Service ("ToS"). If you do not agree to these ToS, you must not use the Website or the Services.

The Website provides information and facilitates reservations for airport parking services at or near Phoenix Sky Harbor International Airport. The Services may include, but are not limited to, providing parking options, booking functionalities, shuttle services, car washing, Turo fleet hosting. Unless explicitly stated otherwise, the parking services listed on the Website are provided by independent third-party parking facilities, and Website acts solely as an intermediary for these services.

3. User Responsibilities

1. You are responsible for providing accurate and up-to-date information when using the Services, including but not limited to vehicle details and contact information.

2. You are responsible for ensuring that your vehicle meets any requirements specified by the parking facility.

3. You are responsible for adhering to the terms and conditions of the specific parking facility you choose, which may include check-in/check-out procedures, parking regulations, and liability limitations. The ToS for our parking operator, Phoenix Parking Solutions AZ, LLC, can be found here.

4. You agree to use the Website and Services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Website and Services.   

 

4. Reservations and Payments

1. If the Website facilitates reservations, all reservations are subject to availability and confirmation by the parking facility.

2. Prices for parking services are as displayed on the Website and are subject to change without notice.

3. You are responsible for paying all charges associated with your parking reservation, including any applicable taxes and fees, as specified at the time of booking.

4. Cancellation and refund policies, if any, will be as specified by the parking reservation aggregator utilized during the booking process. You are responsible for understanding and complying with these policies.

 

5. Intellectual Property

1. All content on the Website, including but not limited to text, graphics, logos, images, and software, is the property of Website or its licensors and is protected by copyright, trademark, and other intellectual property laws.   

2. You may not reproduce, modify, distribute, display, perform, or otherwise use any content from the Website without the prior written consent of Website or its licensors.   

 

6. Disclaimer of Warranties

1. The Website and Services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.   

2. Owner does not warrant that the Website or Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.   

3. AirportParkingPhoenix.com does not guarantee the availability, pricing, or quality of any parking services listed on the Website, as these are provided by independent third-party parking aggregators. Any issues arising from your parking arrangement are solely between you and the parking aggregator.

 

7. Limitation of Liability

1. To the maximum extent permitted by applicable law, Owner shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in any way connected with your use of the Website or Services, including but not limited to damages for loss of profits, data, use, goodwill, or other intangible losses, even if Owner has been advised of the possibility of such damages.   

2. Owner is not responsible for any damage to, theft of, or loss of your vehicle or personal belongings while using parking services booked through the Website.

3. Our total liability to you for any claim arising out of or relating to these ToS or the Services shall not exceed the amount you paid (if any) to Website for the use of the Services.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless Website, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these ToS, your use of the Website or Services, or your violation of any law or the rights of a third party.

The Website may contain links to third-party websites that are not owned or controlled by Owner. Owner has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Owner shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites.   

 

10. Governing Law and Dispute Resolution

These ToS shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these ToS shall be brought exclusively in the state or federal courts located in Arizona, and you hereby consent to the personal jurisdiction of such courts.

In the event Owner prevails in a dispute between Owner and you related to the services provided by Owner to you under these terms of service, you agree to pay all of Owner’s costs and expenses incurred, including reasonable attorney’s fees, in pursuing, defending, or otherwise litigating the situation.

 

12. Changes to These Terms of Service

Owner reserves the right to modify or revise these ToS at any time without notice. By continuing to use the Website or Services after any such changes, you agree to be bound by the revised ToS. It is your responsibility to review these ToS periodically for any updates or changes.

 

13. Entire Agreement

These ToS constitute the entire agreement between you and Owner regarding your use of the Website and Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
